In terms of the Project on cooperation with legal authorities in the course of elaboration and implementation of economic reforms, the Fund assisted the Verkhovna Rada Committee on industrial and regulatory policy and entrepreneurship in the course of elaboration of the Law “On state-private partnership” (SPP), adopted by Verkhovna Rada of Ukraine and endorsed by signature of the President of Ukraine on the 1st of July, 2010.

The elaboration of this Law constitutes an essential step in improvement of regulatory framework. For Ukraine it is necessary to have a legal act, which could declare the country’s readiness to participate in partnership, enhance the range of possible types of SPP, ensure cooperation for long term and guarantee the right of private owner for the return on investments, define mechanisms for the commitments to be met by the country, as well as cover projects’ monitoring system.

The Law “On state-private partnership” enables settling the balance between country’s interests, in particular, in the sphere of reengineering infrastructure, and the interests of private partner as for return on investments, and makes possible the increase of domestic public sector competitiveness. Legislation on SPP should encourage the effective usage of state assets, improvement of industrial and social infrastructures, along with the increase in quality of services, being provided by means of this infrastructure.
